Abstract

The purpose of this study is to understand the form of legal protection for consumers as a result of shopee paylater payments. Nowadays, digital credit with the spaylater feature has become a discussion that is often discussed. The analysis in this study uses qualitative methods and data collection through literature studies based on reading literature that the author has collected previously. The results showed that the use of shopee paylater was also protected by law. Bank Indonesia together with the Financial Services Authority cooperates to protect and provide legal certainty for consumers and business actors in fulfilling the paylater feature. Such legal protection is as stated in Bank Indonesia Regulation No. 18/40/PBI/2016 concerning the management of the payment transaction process. In addition, other rules in the Financial Services Authority regulation No. 77/POJK 01/2016 regarding lending and borrowing services based on digital information technology. With this provision, it is related to digital information technology-based lending and borrowing matters such as pay later. In this case, Shopee Paylater is leaned together with a decision between both parties, namely the lender and the borrower and then a valid agreement is written in the form of an electronic form and this will have an impact on the rights and obligations by various parties.
